Refund and Cancellation Policy

This Refund and Cancellation Policy forms part of the EMRGED Terms and Conditions and should be read together with them. Words given a particular meaning in the Terms have the same meaning here.
1. Your rights under the Australian Consumer Law
1.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this Policy excludes, restricts, or modifies those guarantees, or any other right or remedy you have at law that cannot lawfully be excluded.
1.2 If there is a major failure with the service, you may cancel your membership and obtain a refund for the unused part of it, or seek compensation for the reduction in value. If the failure is not major, we are entitled to put it right within a reasonable time; if we do not, you may cancel and obtain a refund for the unused part.
1.3 Everything else in this Policy is offered in addition to those guarantees, not instead of them. Where this Policy is more generous than the law requires, the more generous term applies.
2. What membership includes
2.1 Membership of EMRGED is by invitation. Before you are invited to submit a profile and pay, we have already read your application and decided to accept you. Payment is not a request to be considered; it is the start of your membership.
2.2 Your membership fee pays for:
- a profile on the EMRGED directory, discoverable by Clients looking for talent;
- specific written feedback from EMRGED on your profile before it is published, so that what goes live gives you the best chance of being found and booked; and
- introductions passed to you when a Client enquires about you.
2.3 We review every profile before publishing it. That review is editorial: its purpose is to help you present well, not to decide again whether you are accepted.
2.4 Current fees, in Australian dollars and inclusive of GST, are $99 every three months (Quarterly), $299 every twelve months (Annual), and $449 once (Lifetime). Fees are charged in Australian dollars; your bank may apply its own currency conversion or international transaction fees, which we do not receive and cannot refund.
2.5 Founding Members are not charged a membership fee. Nothing in this Policy requires a refund of a fee that was never paid.
3. Changing your mind: 14 days
3.1 You may cancel your membership for any reason within fourteen (14) days of your first payment and receive a full refund. You do not have to give a reason.
3.2 This applies whether or not your profile has been published. If it has been published, it will be removed when the refund is made.
3.3 To use this right, email legal@emrged.com before the fourteen days expire, with the subject line “Cooling-off refund”.
3.4 This right applies to your first payment on a new membership. It does not apply to a renewal of an existing membership, which is covered by clause 5.
4. If we do not publish your profile
4.1 In rare cases we may be unable to publish a profile after payment — for example, where the images supplied cannot be used, where information given turns out to be inaccurate, or where publishing would breach the Terms or the law.
4.2 Where that happens and it is not the result of a breach of the Terms by you, we will refund your membership fee in full. You do not need to ask. We will tell you, and refund within ten (10) business days.
4.3 Where a recurring plan has been started, we will also cancel the subscription so that no further payment is taken.
4.4 Where we cannot publish because of something you can put right, we will tell you what is needed and give you a reasonable opportunity to do so before any refund and cancellation.
5. Renewals
5.1 Quarterly and Annual memberships renew automatically until cancelled. We will take payment on the same date each cycle using the card you have saved.
5.2 A renewal is not refundable simply because you changed your mind or forgot to cancel, except where the Australian Consumer Law requires it.
5.3 However, if you asked us to cancel before a renewal was charged and we had not yet acted on your request, we will refund that renewal in full. The date of your email to us is the date that counts.
6. Cancelling your membership
6.1 You may cancel at any time by emailing legal@emrged.com or talent@emrged.com with the subject line “Cancel membership”. We will confirm in writing.
6.2 We will act on a cancellation request within five (5) business days.
6.3 Cancellation takes effect at the end of the period you have already paid for. Your profile remains live until then, and no further payment is taken.
6.4 Cancelling stops future payments. It does not by itself refund payments already made; whether a refund is due is governed by clauses 1, 3, 4 and 5.
6.5 Clause 13 of the Terms separately allows you to cancel, without any cancellation fee, if we make a change that materially affects your rights. Nothing in this Policy limits that right or adds a fee to it.
7. Changing plan
7.1 You may move between the Quarterly and Annual plans. A change takes effect at the end of the period you have already paid for, so you are never charged twice for the same period and no refund arises.
7.2 Moving to Lifetime is a separate one-off purchase. When you take it up we cancel your existing subscription at the same time, so that nothing further is charged.
8. Lifetime memberships
8.1 “Lifetime” means a single payment with no further membership fees, for as long as EMRGED operates the Platform and you continue to comply with the Terms.
8.2 It is not a guarantee that the Platform will operate for any particular period, and it is not transferable to another person.
8.3 Lifetime places are limited in number and are offered until they are taken.
9. Failed payments and suspension
9.1 If a renewal payment fails, we will email you on days 1, 7 and 13 after the failed charge, each time with a secure link to update your card.
9.2 If payment has still not succeeded fourteen (14) days after the failed charge, your membership is suspended. A suspended profile is removed from our directory, from location listings, and from our sitemap.
9.3 The fourteen days are counted from the failed charge, not from when we noticed it.
9.4 Suspension is not cancellation. Paying the outstanding amount restores your profile.
9.5 No refund arises from a suspension caused by a failed payment.
10. Suspension or removal for breach
10.1 Where we suspend or remove a profile because of a breach of the Terms, no refund of fees already paid is given, except to the extent the Australian Consumer Law requires one.
10.2 Where we remove a profile for a reason that is not your fault — for example, because we change what the Platform does — we will refund the unused part of your current paid period. A Lifetime membership is not tied to a period, so there is nothing to pro-rate; your rights under clause 1 are unaffected and any remedy will be worked out in accordance with the Australian Consumer Law.
11. If the Platform closes
11.1 If we permanently close the Platform, we will refund the unused part of any current Quarterly or Annual membership. A Lifetime membership is a single payment that is not tied to a period, so there is no unused part to return; your rights under clause 1 are unaffected and any remedy will be worked out in accordance with the Australian Consumer Law.
12. How refunds are paid
12.1 Refunds are made to the card used for the original payment. We are not able to refund to a different card or to a bank account.
12.2 Refunds are processed through Revolut, our payment provider. Allow five (5) to ten (10) business days for the money to appear, depending on your bank.
12.3 Refunds include any GST component of the original payment.
13. How to ask for a refund
13.1 Email legal@emrged.com with your name, the email address on your profile, and what you are asking for.
13.2 We will acknowledge your request within two (2) business days and aim to resolve it within ten (10) business days.
14. Complaints
14.1 If you are not satisfied with how we have handled a refund or cancellation, email legal@emrged.com with the subject line “Complaint”. We will respond within thirty (30) days.
14.2 You may also contact the Australian Competition and Consumer Commission at accc.gov.au, or the Queensland Office of Fair Trading, at any time. Nothing in this Policy prevents you from doing so.
